Causation
In a personal injury lawsuit, a plaintiff must establish that the relationship between the defendant’s conduct and the plaintiff’s injuries is causal. Causation is one element that can prove negligence. In most personal injury cases, the but-for test is used to determine the defendant’s liability. In other words, had the defendant [done/not done] [some action/inaction] then the plaintiff would not have suffered [the injuries].
