      Comparative Negligence

      Comparative negligence holds that two individuals can be held simultaneously at fault for one accident. California law has a “pure” comparative negligence rule. So long as one party is not 100% liable for an accident, he or she may bring a cause of action against the other party. However, damages are reduced by the percentage of blame the party is ascribed in the accident. In other words, if one party is held to be 25% at fault for an accident and was awarded $10,000, he or she would receive an award of $7,500.
