Contributory Negligence
California operates on a pure comparative negligence system. Contributory negligence rules, bar a plaintiff from recovering damages if it can be established that they contributed fault or were even partly responsible for their own injuries. Most states have modified comparative fault rules that bar plaintiffs from recovery if they can be shown to be 50% or 51% at fault for the accident. In California, you can sue even if you are 99% at fault for an accident.
